TERMS OF SERVICE

The Client must read, understand and agree to all the below terms before entering into an agreement with me.

1. I have the right to decline any commission request. 


2. Commissions are for personal use only unless discussed otherwise. Please communicate with me if you intend to use the artwork for commercial use (selling the artwork / for monetary gain) as it will incur a commercial fee for (2x) the original price. I own all the rights to my work, including the rights to distribution (i.e., to create prints, merchandise, etc.).


3. The Client may not re-distribute, reproduce, or sell my work, or profit from the artwork. 


4. The Client is not permitted, under any circumstances, to use any part of their commissioned artwork for non-fungible tokens.

5. Client rights can be negotiated for an added fee. If the commissioned image will be used for commercial purposes, I must be notified before the start of work. Commercial use of images will result in an increased commission price. New terms of service must be decided upon before I begin any work on a commission for commercial use. â€‹


6. I retain the right to display/reuse all commissioned work on any personal website, social media, gallery, or journal unless specifically requested, but may incur an additional 40% privacy fee. I am also allowed to post processes on my social media unless discussed otherwise. I do not post all commissions.

7. I will not share Client contact information, and will only use the client’s information for communication purposes during the commission process.

8. All prices are expressed in U.S. Dollars and payments are to be made using PayPal and addressed to bananaqiartstudio@gmail.com.

9. I require full payment upfront before starting on your commissions. 

​

10. The prices of each piece vary according to complexity, do communicate with me your requests, and I’m more than happy to work with you on the details!

11. Refunds are allowed to be requested if the commission has not been started, no refunds otherwise. PayPal fees will not be refunded. 


12. Gratuities are appreciated, but not expected.

13. For character references : Please provide a finalized design / character sheet before you decide to commission me, as I will not be able to change the artwork after the Line art process has started. If the character’s design details changes after the

Line art process, I will incur a fee to apply the changes. â€‹

14. For changes : Small changes are allowed during the sketch stage (expressions, hand placements, etc.), but Bigger changes (the whole look of the commission) will incur an additional fee. Please provide references and communicate with me about any specific action / pose you want so I can fulfill your request more accurately! I reserve the right to make creative decisions on the commission if a vague pose (ex: looking at the screen) is requested! 


15. Alterations to the image during creation are in my description.

16. The commissioned work may take from a week to a month and a half, depending on my schedule and the complexity of the request.

17. No deadlines please! I won’t be able to work on pieces well under pressure. In the case that the artwork is needed fast, a rush fee may be added. For more complex pieces, if I require a longer deadline I will communicate with you. 

​

18. Due to the interactive nature of the creation process, I am not responsible for commissions exceeding a deadline due to lack of response from the client.

19. You will receive a full-resolution digital file. No physical item will be delivered. 

​

20. The Client may exhibit the commissioned work in any online / offline art gallery without my permission, but is required to include credits to my social media. I really appreciate it! 


21. The Client may resize / crop the commissioned artwork to create icons, wallpapers, or other graphics to be used in non-commercial digital format, but the client cannot alter the artwork itself. 


22. The Client may not have another artist's work or add anything to my work unless I am informed before the start of the work and I agree. 

23. I DO NOT ALLOW my works to be sold on ANY type of website / platform.

COMMISSION WORKFLOW

1. Fill in the form. 

2. I review your form and contact you through Twitter (preferably). We discuss about your commission and I'll provide a quote. When you've agreed to the price, I'll send you an invoice via PayPal. 


2. After payment is made, depending on my queue and schedule, I will send a sketch to you within the month. (I do not work on all commissions at the same time hence I cannot guarantee you’ll be getting the sketch within a week of payment, I prefer concentrating on a max of 2 commissions at a time, and normally according to my queue to maximize efficiency!)

3. After I send you the sketch, in order to be as efficient as possible, I require revision requests and / or comments. I will allow time for the client to respond with revision requests. It’ll be corrected then! (Note : The overall pose cannot be changed if the sketch has started. Hence please be clear if there is a specific pose you want your character to be in. If not I will be making creative decisions on the description provided. )


4. After you confirm the sketch, I’ll move on to Line art and color to complete the commission. As the artwork progresses, the client may not request changes to a previously agreed-upon step. For example, the client may not request changes to line work once rendering has begun.

5. After everything is finished, I’ll be sending you a Google Drive Link containing the files and an unwatermarked piece of the commission~! 

​

6. You may request specific dates for me to upload the commissioned artwork. If the artwork is used on your social media platforms : Profile picture, stream thumbnail, banner, etc.
